Fifthly, the ruling on replacing the slaughter of the gift with charity
Delay the Qur'aan, Sunnah, and the consensus and fill out
the excuses that it is not permissible to replace the slaughter of the gift

with the Qur'aan. As for the consensus, the Sahaabah and the followers and
those who follow them from the diligent people have taken the evidence

offer guidance to the one who enjoys it and the one who compares it. If he does
not find a gift or does not find the price, then he fasts ten days three times
in the Hajj and seven if he returns to his family. That.
As for filling the excuses, it is permissible to say that
replacing the slaughter of the gift with the trust in its value has led to the
expansion of the doors of the law, for example, it is said: the expense of Hajj
instead of Hajj, because of its difficulty in this era. And there is almost

and then follow every suspicion of its answer.
The first suspicion: It may be said that the permissible
because of the difficulty of organizing the slaughter at the present time with
the survival of the spoiler as it is, and perhaps increased with the increasing
number of pilgrims. This misconception can be answered by one of the following
matters: that the misuse of the order by the people is not permitted to be
transferred to an order which they have not initiated on the grounds that it is
easier for them to apply.
Secondly, this is a ruling based on an annulled interest.
The scholars have decided that the interests of the three departments are
considered to be of interest and that the interest is canceled. On it or on the
price of it goes to fast.
The third is that this worship is meant to shed blood, but
meat is intended by the second intention. Allaah says (interpretation of the meaning):
"God will not receive her flesh or blood, but he will receive the piety of
you."
The second suspicion is that some pilgrims do not give the
price of the gift they owe to the deceased and their workers themselves in the
power of attorney, since they do not engage in buying, slaughtering, and
honoring the meat, because it is not possible for them and fear of loss due to
overcrowding, hardship or embarrassment.
It is possible to answer this suspicion by answering the
first suspicion. Moreover, if a person who buys a gift for him and slaughters
him and distributes it to those who are entitled to the shar'i status, he is
exempted from the custody of the gift, and he becomes the custodian of the
person who became an agent to buy, slaughter, the power of attorney is lawful.
The third suspicion is that the prevention of evil is
provided to bring interests and thus to ward off evil for the nation and bring
to its own interests.
It is not correct to say: The slaughter of gifts is corrupt
and if it is prevented by what they mentioned, this ritual is canceled and the
price is correct. Because of the rules prescribed in the Shariah That the harms
are degrees and that the interests are degrees and that it is permissible to
miss the two best interests in order to collect the highest and commit the
lesser of the spoilers to avoid them as a grave and to prevent evil. The
interest is more likely than what is thought to be a misrepresentation of the
texts on their positions and purposes.
Second: This opens the door of manipulation in the law does

perceptions that they claim interests deserve to be submitted to the evidence.
Thirdly, the prohibition of worship is based on the timing. It is not
permissible to turn away from the project except with valid evidence that is
required for the transgression and any legislation based on timing. It is not
subject to ijtihad.
Fourthly: It is obligatory for him to give it to his due, as
it says in the verse: " Eat from it and feed the needy poor "
[Al-Hajj 28], as well as all other rights, such as zakat, vows, kafarat and
others.
Fifth: The street did not prevent slaughter in any place of
the Haram as he said - peace be upon him -:)

Sixth: The treatment of the meat problem in Mina: The

Expanding the distribution of what is greater to the poor of the Haram on the
poor outside the Haram and giving the poor who are outside the Haram to pay the
Zakat for the poor, not the poor of the country of money if given the poor
country of money need and no one deserves, so the gift transferred to the poor
countries neighboring Mecca.
The extension of the power of attorney to slaughter the gift
in an orderly manner that ensures the interest of the owner of the gift and the
interest of the poor and the public interest and in which people are supervised
by the state to apply this. This is what is easy to mention and God is a
